Avui, des de <strong>Fundaci\u00f3 Mutua Propietarios<\/strong> t&#8217;expliquem com ha de ser l&#8217;accessibilitat en edificis existents.<\/p>\n<p>&nbsp;<\/p>\n<h2>\u00c9s obligat\u00f2ria l&#8217;accessibilitat en els edificis?<\/h2>\n<p>Abans de res, has de saber que en el cas d&#8217;immobles ja existents, la reforma de la Llei de Propietat Horitzontal empara a qualsevol persona amb una discapacitat o major de 70 anys que sol\u00b7liciti l&#8217;accessibilitat de l&#8217;edifici, fins i tot en el cas que aquesta comporti la modificaci\u00f3 del t\u00edtol constitutiu.<\/p>\n<p>Si aix\u00f2 pass\u00e9s, la comunitat de propietaris est\u00e0 obligada a realitzar ajustos en les zones comunes de l&#8217;edifici per a garantir l&#8217;acc\u00e9s i, a m\u00e9s, com d\u00e8iem anteriorment, l&#8217;hauria d&#8217;haver realitzat abans del 4 de desembre de 2017.<\/p>\n<p>Per tant, has de tenir al cap que tant si l&#8217;edifici \u00e9s de nova construcci\u00f3 com si ens referim a un ja existent, l&#8217;accessibilitat \u00e9s obligat\u00f2ria i qualsevol comprador o propietari de l&#8217;immoble pot sol\u00b7licitar la supressi\u00f3 de les barreres arquitect\u00f2niques.<\/p>\n<p>&nbsp;<\/p>\n<h3>Qu\u00e8 entenem per barreres arquitect\u00f2niques?<\/h3>\n<p>Les barreres arquitect\u00f2niques s\u00f3n un conjunt d&#8217;elements que dificulten el desenvolupament de l&#8217;activitat normal per part de persones amb discapacitat sensitiva i\/o motora d&#8217;una manera aut\u00f2noma i segura. Aquestes barreres les podem classificar en dos grups:<\/p>\n<p><strong>Barreres arquitect\u00f2niques pr\u00f2piament dites<\/strong><\/p>\n<p>On l&#8217;acc\u00e9s i la mobilitat per un determinat espai no estan adaptats a persones amb mobilitat redu\u00efda o una altra limitaci\u00f3. En aquest apartat incloem els accessos amb escales i sense rampa, els passadissos estrets, els banys no adaptats.<\/p>\n<p>Barreres urban\u00edstiques<\/p>\n<p>Generalment en espais p\u00fablics, on no es tenen en compte les caracter\u00edstiques especials de les persones discapacitades. Les voreres sense rebaixar i els sem\u00e0fors sense indicacions ac\u00fastiques serien un exemple.<\/p>\n<h2>Accessibilitat en un edifici existent<\/h2>\n<p><strong>La Llei d&#8217;Igualtat, No Discriminaci\u00f3 i Accessibilitat Universal<\/strong> i els seus reglaments de desenvolupament s\u00f3n el marc jur\u00eddic general que protegeix i garanteix el dret a la igualtat de les persones amb discapacitat. Per part seva, el Codi T\u00e8cnic d&#8217;Edificaci\u00f3 en el document b\u00e0sic de seguretat d&#8217;utilitzaci\u00f3 i accessibilitat, en la seva secci\u00f3 9 i en els documents de suport, estableix com han d&#8217;adequar-se les condicions d&#8217;accessibilitat en edificis.<\/p>\n<p>A l&#8217;hora de considerar accessible un edifici, aquest ha d&#8217;estar <strong>exempt de barreres en el seu entorn,<\/strong> possibilitant que les persones majors amb mobilitat redu\u00efda o persones amb diversitat funcional, auditiva o visual, puguin continuar vivint en les seves llars mantenint el m\u00e0xim grau possible d&#8217;autonomia personal.
